A civil partnership is a legally recognized relationship between two people, offering similar rights and responsibilities to those of marriage, but with some key differences. It’s a formal arrangement, created by signing a civil partnership document, rather than exchanging vows.
Civil partnerships grant similar rights and obligations to marriage. Civil partners are treated similarly to married couples in areas such as tax, immigration, and citizenship. The Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2010 outlines the rights and obligations, which are largely the same as those for married couples. These include rights related to social welfare, tax, life insurance, pensions, inheritance, maintenance, and the shared home.
The Marriage Act 2015, which came into effect on November 16, 2015, allowed same-sex couples to marry. Consequently, new civil partnerships can no longer be registered in Ireland. Couples already in a civil partnership can choose to marry, which automatically dissolves their civil partnership, or remain in their civil partnership. Civil partnerships registered abroad after May 16, 2016, are not recognized in Ireland.
In the event that your civil partnership breaks down you will need to apply for a dissolution which is the equivalent of a divorce. If children are involved legal representation can ensure the appropriate arrangements are made. The court may end a civil partnership on an application by either of the parties.
Upon dissolution it is open to either partner to make an application in relation to the partnership finances, and such issues are dealt with in very much the same manner that financial disputes between married couples would be dealt with.
