What should you do when you are involved in a road traffic accident?

It is important to take the following steps:

  • Record the details of the other party at the scene, including name, address, telephone, insurance details and vehicle registration number.
  • Report the incident to the Gardai immediately. If for any reason this is not possible, report the accident in-person to a Garda station as soon as you can (and get a Garda reference number).
  • Take details of any other party and any witnesses.
  • Contact your own insurers.

Legal Action after a Road Traffic Accident

It is vital that, where you are injured or your car is damaged in a road traffic accident, you are able to provide as much information as possible. This will include several different types of information, including, where possible:

  • Photographs of the accident and the damage to the vehicles and injuries caused;
  • Photographs of the scene of the accident;
  • Details and results/[solicit] of costs incurred for any medical care and/or the likely cost of repair to the car; and
  • Witness details and contact telephone number and address.

It is important to understand that claiming compensation for a road traffic accident can be a complicated process.  In the first instance, if you are injured, if you believe that someone else was at fault, you must apply to the Injuries Board to have your claim assessed – if the parties being held responsible permits it to do it, this will determine the award that a claim could be worth.  It is only after the Board’s authorisation is granted, or an assessment is made and is rejected by either or both parties, that a claim may be brought before the Courts.  Each of these fora has particular procedures and protocols, which can be difficult to navigate, and should be handled by an expert Irish road traffic accident legal advisor familiar with them.
