Alex worked as a landscaper on a construction site. At the time of his injury, he and his colleagues maneuvered a tree suspended from a teleporter into a previously dug hole. While aligning the tree with the hole, Sean’s right ankle became trapped between the suspended tree and an adjacent metal grate. He shouted out to his colleagues, and just as the teleporter attempted to lift the tree away from him, a second impact occurred, causing him serious personal injuries, loss, and damage. Alex felt the crushing pressure on his leg despite wearing industry-standard safety boots. He took a few days off work and felt pressured to return.
He visited his General Practitioner, who sent him to the hospital. In addition to pain in his right ankle, Alex also developed pain in his right knee, particularly when bearing weight, along with a clicking sensation during movement. The doctor advised him that he had sustained a soft tissue crush injury to his ankle, which caused him to limp. Alex received a work certificate and the doctor suggested that if his symptoms did not improve, physiotherapy would be beneficial.
Four months after the incident, Alex still experienced pain in his ankle, despite undergoing about six physiotherapy sessions and planning to attend more. His injury forced him to change the nature of his employment, as he could not engage in full personal fitness training for fear of further aggravating his ankle and knee.
Partner Caoimhe McConnell initiated court proceedings, leading to a successful conclusion of the case.
