Kathy worked as a healthcare assistant at a nursing home when an incident occurred. While she assisted a service user with a fellow employee, her colleague suddenly pushed the client towards her. As a result, the client lost balance and fell on Kathy, causing her to strain her back while trying to break the fall.
Immediately after the incident, Kathy felt significant pain in her upper back, predominantly on the right side. She experienced a wrenching sensation and appeared visibly distressed. Due to the persistent pain in her upper back and shoulder area, she sought medical attention from her GP.
Initially, Kathy was absent from work but attempted to return after a period of rest. Unfortunately, her symptoms flared up, and despite several efforts to resume her duties, she could not continue working due to ongoing pain and discomfort. Everyday activities, such as driving and carrying items, aggravated her symptoms.
Kathy also reported worsening neck pain when sitting or standing for long periods or performing domestic tasks. Her neck’s range of motion was restricted, leading to a referral for further specialist assessment, including neurophysiological investigations and physiotherapy treatment. Imaging of her cervical spine later revealed changes suggestive of nerve impingement and disc protrusions, which contributed to her ongoing symptoms.
It was argued that adequate systems, training, and care protocols could have prevented the incident. The actions of her colleague, for which the employer was vicariously liable, directly led to her injury.
Partner Caoimhe McConnell initiated court proceedings, leading to a successful conclusion of the case.
On June 19, 2025, the parties settled the case for €120,000. This outcome was exceptional for our client, and we are proud of all the hard work Caoimhe McConnell and her team put in to achieve this brilliant result.
