Case Summary

Incident

During Mark’s employment, his supervisor instructed him to remove packages of batteries from pallets located in a storeroom on the premises. As he removed the packages, he suffered serious personal injuries, loss, and damage. Mark had to remove an estimated 400 batteries from each pallet. While doing so, he felt a sudden pain in his groin and noticed a lump in his right groin. He visited his General Practitioner, who diagnosed him with a right inguinal hernia.

He experienced acute pain in his right groin, which radiated down towards his testicle and upwards towards his abdomen. The doctor referred him to the hospital for surgical repair of the groin and to address suspected nerve damage. After the surgery, Mark’s pain worsened, and he developed anxiety and depression, preventing him from returning to work. During a follow-up, Mark described persistent pain and a dragging/aching sensation, along with nausea and urinary problems. His mental health further declined, severely limiting his activities.
