Case Summary

Incident

Peter initially worked as a driver. His duties later expanded to include working as a security operative at the Defendant’s premises in a hospital. He drove the Defendant’s doctors from the premises to patients’ homes and patrolled the premises each night he was on duty.

On the night of the incident, he received directions to patrol the premises. Around midnight, while patrolling, his foot became caught in a hole in the ground, causing him to fall and suffer personal injuries and expenses. Peter sustained a wound to his forehead and a head injury. A doctor on duty at the premises treated him, and an ambulance transported him to the Emergency Department afterward.

As a result, Peter has faced significant disruptions in his work life and daily activities. He has been unable to work following the accident. Every employer has a duty of care to ensure the well-being of their workers and to provide a safe and hazard-free work environment. In this case, the employer failed to address the risk, which led to Peter’s accident.
